Virtus Health Facebook Forum Terms and Conditions

1. Introduction

These Terms and Conditions for the Virtus Health Facebook Patient Forum (Forum Terms) operate concurrently with the Virtus App Terms of Use.

The Forum Terms are an agreement between you and Virtus Health Limited ACN 129 643 492 and its related companies (Virtus), being:

-IVF Australia Pty Limited, ACN 098 082 109 (IVFAustralia);

-Melbourne IVF Pty Limited, ACN 007 243 352 (MelbourneIVF);

-Queensland Fertility Group Pty Limited, ACN 010 514 397 (QFG);

-TasIVF Pty Limited, ACN 122 826 939 (TASIVF);

-The Fertility Centre Liverpool, ACN 098 082 109;

-The Fertility Centre Wollongong, ACN 098 082 109;

-The Fertility Centre Dandenong, ACN 007 243 352;

-The Fertility Centre Werribee, ACN 007 243 352;

-The Fertility Centre Preston, ACN 007 243 352;

-The Fertility Centre Springwood, ACN 010 514 397;

-The Fertility Centre Gold Coast, ACN 010 514 397;

-Regarding your use of the Virtus Health Facebook Forums (Patient Forums). Access to and use of the Forum is subject to the conditions specified in these Forum Terms.

By clicking the 'Accept' button, or otherwise using and accessing the Forum, you accept all of the Forum Terms and agree to be bound by them. You must accept the Forum Terms to use the Forum.

Virtus Health reserves the right to amend the Forum Terms from time to time.

Virtus will notify you of any amendments to the Forum Terms by posting them on the Forum. Your ongoing use of the Forum following any changes to the Terms will confirm your acceptance of the changes.

2. Purpose of Forum

The Forum is a platform for patients of IVFAustralia, Melbourne IVF, Queensland Fertility Group and TasIVF to discuss with each other their ideas and experiences. It is designed to allow open, informative and supportive discussion about fertility issues and experiences while undergoing fertility treatment. Information posted in the Forum should not be relied upon as medical advice and is only intended to complement the existing treatment plan you have in place with a Virtus clinic.

3. Use of Forum

i) Use by Virtus patients only

The Patient Forums are for the exclusive use of patients of IVFAustralia, MelbourneIVF, Queensland Fertility Group and TasIVF. If you cease to be a patient of one of these clinics you must notify the clinic immediately and cease using the Forums.

ii) Respect for others

There may be differences in opinion between members of the Forums. Discussions and debates are welcome provided respect is shown for other members who hold different opinions. Disrespectful or aggressive Forums posts will not be tolerated.

iii) No inappropriate language

The use of inappropriate or offensive language is prohibited on the Forums. Inappropriate or offensive language includes, but is not limited to, any language or content that is inappropriately sexually oriented or sexually suggestive, abusive, harassing, defamatory, vulgar, obscene, profane or hateful, or contains racially, ethnically or otherwise objectionable material of any kind.

iv) No complaints about specialists or staff

Whether posted on the Forums or on other social media, posting complaints or concerns about specific specialists or staff may constitute defamation, and leave you open to a claim. The Forums are not a suitable place for these kinds of complaints or concerns. If you have feedback or concerns about a particular specialist or staff member, please let Virtus know directly either in person, or by contacting the patient services team at your clinic.

v) Forum categories

To make it easier for all Forum users to find information of relevance to them we ask that you post new topics under the appropriate Forum categories. Descriptions are provided for each Forum category to help you decide which category to post to. If you have a suggestion for a new Forum category, please email [email protected]

vi) Third party websites

Users are discouraged from linking third party websites in the Forum as the accuracy of information contained on third party websites cannot be verified by Virtus. Virtus does not endorse, nor is it liable for any third party websites or resources, or any content, products or services made available through such websites or resources. You assume all risk arising from access and use of third party websites.

vii) No advertising

Advertising is not allowed in any form on the Forums. If a Forum post refers to any specific product, practitioner or process, it does not imply that it has endorsement by Virtus.

4. Role of Moderator

The role of the moderator is to edit or remove posts in the Forums that breach the Forum Terms or are otherwise considered to be inappropriate. The role of the moderator is not to review forum posts to determine the accuracy, completeness or reliability of information posted in the Forums.

If Virtus decides, in its sole discretion, that you are not using the Forums appropriately, Virtus reserves the right to review, edit, move or delete any material posted in the Forums without notice to you. Your Forums access may also be restricted or stopped.

If you are not sure whether the content you want to post is appropriate, you may contact the Forum admins for advice.

5. Reporting Posts or Making a Complaint

If you feel a Forum post is abusive or offensive, or you wish to complain about the conduct of a Forum user, you can report it to the moderator by direct messaging the admins and moderators. The Forum moderators will review the complaint and decide what action (if any) is appropriate.

6. Liability and Indemnity

Content published on the Forums contains information created by people independent of Virtus. Virtus is not responsible for the accuracy, completeness or reliability of information posted in the Forums and Virtus denies liability of any kind arising out of use, reference to, or reliance on that information.

You agree to indemnify Virtus and its affiliates, committee, agents, representative and third party service providers, and to defend and hold each of them harmless, from any and all claims and liabilities (including legal fees) which arise from your use of the Forums.

7. Governing Law

The Virtus Health Facebook Patient Forum Terms, and any action related to the Forum Terms, are governed by the laws of Australia and you and Virtus submit to the exclusive jurisdiction of the courts of Australia.
